South Africa's Supreme Court of Appeal ruled 3–2 on October 28 that poultry and eggs destroyed in a 2021 avian influenza outbreak must be compensated at fair market value, as if uninfected. The South African Poultry Association said the ruling could encourage farmers to report outbreaks, and the judgment could still be challenged in the Constitutional Court.
Fair-market compensation may make farmers more willing to report outbreaks early, which could shorten disease spread and limit large-scale poultry losses. The ruling has no immediate effect on feed or commodity supply.
